The digital permit application put into practice

Since September 1, 2014 digital permit applications have become a reality.
 
On April 4, 2014, the Flemish Government decided in a Decree to make applications for permit possible via a digital platform.
 
More specifically, this concerns applications for a building permit, an allotment permit, a planning certificate, an urban development certificate, and a registration application based on the presumption of a permit.
 
The permit application can be submitted digitally to the environmental counter in municipalities in which the system is already active.
The files should be virus-free, can be copied, opened and read. These conditions are prescribed under penalty of inadmissibility of the application.
 
The electronic record is available for the following parties:
- The applicant and his architect,
- The municipality and the county in which the property is located,
- The advisory bodies in case they should provide advice,
- The Association of Architects, General Administration of Patrimonial Documentation, and the Flemish Energy Agency for the performance of their tasks, 
- Third parties who may wish to consult the file in the context of a public inquiry or when the decision is announced (only the documents that are not protected by copyright or that are not protected by privacy laws), and
- The Department of Planning, Housing Policy and Heritage of the Flemish Government. 

The license will also be handled digitally. The advisory bodies will be able to upload their recommendation in the electronic file. The licensing authority may also notify its decision via the environmental counter.
The above regulation has already been put into practice since September 1, 2014, in the municipalities of Brasschaat, Wetteren and Maasmechelen, where the first digital permit applications have been successfully submitted.
 
For the timing of the rollout of the electronic counters in the other municipalities of the Flemish Region, please refer to the table on www.omgevingsloket.be. In the city of Antwerp, for instance, the submission of digital license applications is expected to be possible for the autumn of 2014.
