New obligations concerning ventilation entered into effect on 1 January 2016

The Flemish Government wishes to see better-quality ventilation in residential properties, and so it has introduced a number of new provisions into the Ministerial Decree on the form and content of the starting declaration of 13 January 2006.

Concretely, two new obligations are being introduced :

  • Firstly, a preliminary ventilation design must be drawn up before the start of the activities;
  • secondly, it is obligatory, after the execution, to have a performance report prepared on the installed ventilation system, in which the characteristics and the achieved performances of the ventilation system are tested against the performance criteria of the ´STS-P 73-1 - Systems for basic ventilation in residential applications´.

All of this must be done within the framework of the EPB declaration and forms an integral part thereof. 

A ´ventilation reporter´ must be appointed who ensures the fulfilment of these obligations. This can be an architect, an engineering office or an EPB reporter. A list of authorised ventilation reporters will be available online.

These obligations will apply to new projects and the fundamental energy renovation of buildings for which the urban development permit application or notice is filed as of 1 January 2016.
